“Today thanks to hard work and patience of a local investors Adam Guiffrida, we are proud to say we have scored our first but not last official victory. Several years ago the City of Scranton decided that tripling fees for its rental registration program was going to be one of the answers to its insolvency. Today the City has realized that the law has been written to protect its very own citizens. We have proven that it is illegal to generate revenue from “Fee-Based Services,” such as rental registration. Besides the financial aspect of the City’s ordinance being illegal, its inspection portion has also been shot down. Scranton once reserved the right for City inspectors to annually inspect rental properties throughout the City. This cost was passed on to each property owner at a total of $150 per building. After several years of battling, the inspection part of the ordinance was deemed unconstitutional. From today moving forward, there will be no inspections of rental properties based on the application of a rental registration. As a result, the previous $150 per building fee is now disregarded. The new reduced fee will be set at $45 per unit. Scranton will now refund those inspection fees it has previously collected from landlords that have paid them. In addition, Scranton will pay legal fees to all attorneys involved in this matter.
